These vehicle rental conditions are an integral part of the rental contract and regulate the contractual relationship between Rent a Car Montino, acting as lessor, and the client, hereinafter "the lessee". Under this contract, the lessor grants the lessee the use of a vehicle for the period, price and other conditions detailed therein.

By signing the contract, the renter accepts all the terms and conditions established by Rent a Car Montino.

Lease Requirements

To rent a vehicle, the lessee must meet the following requirements:

Identification: Present an Identity Card or Passport, both valid at the time of the celebration.
Age: Be at least 25 years old at the time of renting the vehicle.
Driver's License: Possess a validly issued driver's license that enables the renter to drive the rented vehicle. Foreign driver's licenses that are valid at least until the date of return of the vehicle are accepted.

Vehicle Return

The rental contract will have the duration initially agreed upon, at the end of which the client must return the vehicle to Rent a Car Montino. However, the rental may be extended, provided that the lessee communicates this request in a timely manner before the end of the contract and there are vehicles available for this purpose.

The renter is obliged to return the vehicle, together with the keys, documentation and all its accessories, in the same condition in which they were delivered, at the agreed place and on the date indicated in the rental contract. Delivery and return must be made within the normal business hours of Rent a Car Montino (09:00 to 19:00 hrs).

In the event that the vehicle is not delivered at the agreed location (either at the Airport or in Coyhaique), a charge equivalent to the total amount of the deposit made at the time of signing the contract will be applied. In addition, if the renter does not request an extension of the lease and does not return the vehicle within the period specified in the contract, Rent a Car Montino reserves the right to take the necessary legal action to recover the vehicle as soon as possible and will retain the total amount of the deposit as a penalty for non-compliance.

The rate specified in the contract will apply for the period specified in the lease. In the event of a delay not agreed upon, the rate in effect at the time of expiration of the period stipulated in the lease will be charged.

In the event of loss or misplacement of keys, accessories and/or vehicle documents, the lessor will be authorized to charge for their replacement and transfer the corresponding cost to the lessee.

The rental price of the vehicle does not include gasoline costs or parking at Balmaceda Airport.

The lessee may return the vehicle at the same pick-up location or at a different one, at no additional cost, as long as it is within the city radius. The lessee may also request delivery and/or collection of the vehicle at his/her home or another mutually agreed location, subject to confirmation of feasibility by the lessor.

The vehicle must be returned clean inside. If it is returned or returned dirty, a charge will be made for the guarantee.

The vehicle must be returned with a full tank of gas. If it is not returned with a full tank of gas, an additional charge will be applied and deducted from the warranty.

The rental day is considered to be from 8 am to 7 pm on the same day. The refund of the deposit, in case of additional charges, will be made by bank transfer.

Authorized Drivers, Permitted Uses

Upon delivery of the vehicle, the lessee must present a valid driver's license to drive the rented vehicle. The vehicle may only be driven by the lessee or by those persons expressly designated in the rental contract; additional drivers must show their identification document and driver's license.

The vehicle may only be used on public roads and highways (roads that appear on official maps) within the Aysén region.

Traffic Restriction: The renter accepts that the vehicles rented by Rent a Car Montino are authorized only to transit within the Aysén region. Any use of the vehicle outside this region will constitute a breach of the rental terms and will result in a charge equivalent to the total of the guarantee provided at the time of rental.

It is expressly prohibited:

Participate with the vehicle in races, contests or challenges of any kind
Use the vehicle for driving practice and/or testing in
Transport people or goods for consideration.
Sublease the vehicle.
Committing criminal acts with the vehicle.
Driving under the influence of alcohol, drugs, psychotropic substances or any disease that incapacitates driving.
Using the vehicle to tow other vehicles.
Continue using the vehicle if it displays warning signs and/or alarms indicating damage.
Transporting substances toxic, flammable and/or
Intervene, extract or manipulate any part of the vehicle without the express authorization of Rent a Car
Attaching a trailer or making modifications to the vehicle to install accessories without prior authorization from Rent a Car Montino; otherwise, any damage caused to the vehicle will be borne by the

The charges for repair and/or replacement of accessories that must be assumed by the renter will include the cost provided by each supplier, with no additional charge by Rent a Car Montino.

The vehicle may not leave the country temporarily or permanently, unless authorized by Rent a Car Montino through a power of attorney.

The lessee will be personally and jointly responsible for the persons who drive the vehicle during the rental period, whether with or without his authorization or knowledge.

If the vehicle has a mechanical failure, the lessee must immediately notify the lessor by phone, WhatsApp, text message or other effective means of providing proof of notification. The vehicle must be left in the nearest and safest place available. In the event that the vehicle needs to be moved by a tow truck, the lessee must request this from the lessor and cover the cost of the move if the vehicle was damaged or involved in collisions during the rental.

Without prejudice to the lessee's liability to third parties, if any of the prohibitions established in the previous points are incurred, the lessor may terminate the contract immediately and claim compensation for damages, including loss of profits caused by such non-compliance.

Tenant's Responsibility

The lessee receives the vehicle in a good state of maintenance and preservation, with all its equipment and the details previously informed before delivery. The client agrees to return the vehicle in the same condition, together with all its accessories, parts and pieces.

The lessee is liable to the lessor for any damage or theft of the vehicle, as well as for any damage resulting from breaches of contract, except for the limitations of liability that the lessee agrees to. This also applies to the legal provisions in force in matters not regulated in these clauses. The lessee will also be liable for any infringement that he may commit during the rental,

especially for traffic violations. Likewise, the renter exonerates Rent a Car Montino from any penalty, fine, fee, surcharge and, in general, from any type of cost imposed for this concept.

Landlord's Responsibility

Montino Rent a Car is not responsible for the theft of objects that are stored inside the vehicle while it is being rented.

Furthermore, the lessor will not assume responsibility for the loss or damage of said objects as a result of an accident.

In the event of a vehicle accident, this does not automatically imply the lessor's obligation to provide a replacement vehicle. If a replacement vehicle is delivered, this will be subject to availability at that time. The delivery of a replacement vehicle will be considered a new lease, which entails the signing of a new contract, the delivery of a new guarantee and the respective payment.

Tenant Charges or Costs

The lessee shall be liable for all damages caused to the vehicle or its accessories, whether by himself or by a third party. This includes damages resulting from traffic accidents, whether to persons or property.

The insurance will only cover damages in accordance with the current policy contracted by the lessor (total loss). Any damage or accident that exceeds the amount indicated in the policy or that is not covered by the insurance company will be the responsibility of the lessee.

In addition, the lessee will assume the costs of damages caused to third parties, to their persons, vehicles or property, whether moral or material, as a result of the use of the vehicle.

The costs of transporting the vehicle to the address of Rent a Car Montino (Pasaje Santa Eliana S/N, El Verdín, Coyhaique, Aysén Region, Chile) from the place where it was left by the renter, including situations of traffic accidents, will also be the responsibility of the renter.

In the event of any of these events, the tenant must immediately inform the landlord in writing or by phone, WhatsApp, text message or other effective means that proves notification. In addition, the tenant must notify the competent authorities, if applicable, within a period of no more than 24 hours from the incident. This will allow the insurance policy to be activated, if the landlord considers it appropriate to do so (although it is not obliged to do so).

The tenant must refrain from making statements that in any way compromise the landlord. If this point is violated, the liability and cost of all damages will be borne by the tenant.

In the event of an accident, theft or robbery of the vehicle, the respective accident affidavit must be completed and/or a complaint filed with the Carabineros of Chile, as appropriate.

If there are no injured third parties, the renter must make a simple sworn statement at Rent a Car Montino or send an email to contacto@rentacarmontino.cl, detailing the circumstances of the accident within a period not exceeding 24 hours from the events. Failure to comply with this obligation will result in immediate collection of the entire amount of the guaranteed guarantee, without the right to make a subsequent claim.

The renter will be responsible for damage to the vehicle caused directly by the driver's fault and/or failure to comply with the manufacturer's recommendations.

Regardless of the magnitude, nature and/or cause of the damage caused to the vehicle, the lessee must pay an amount of 20 UF (Chilean Development Units) as compensation and costs for stopping the vehicle, an amount that may be deducted from the guaranteed guarantee.

The rental charges for the vehicle are those indicated in the respective booking confirmation, unless a discount or special price has been agreed. The prices established by Rent a Car Montino are flexible and may vary without prior notice, without affecting the values of already confirmed reservations.

Additionally, the charge for delivery of the vehicle at the airport will be reported according to the rate indicated in the quote.

Reservations

At the time of quoting a vehicle rental, the prices, brands and models of the available vehicles will be confirmed.

Cancellations or changes to reservations must be communicated at least two weeks in advance of the reserved date, either by email to contact@rentacarmontino.cl or by phone at +569 22577313.

After this period, no refunds will be made for reservations cancelled in advance.

Use of the Vehicle

The lessor delivers the vehicle detailed in the rental contract in proper working order, together with the complete documentation, key and accessories. It is the lessee's obligation to carry out a visual inspection of the condition of the vehicle and its accessories; failure to do so will be the lessee's sole responsibility.

The lessee undertakes to use the vehicle and its accessories diligently and to return them in the same condition in which they were delivered. He must also allow the relevant safety inspections to be carried out and drive the vehicle in compliance with current traffic regulations.

The lessee receives the vehicle with a full tank of fuel and is obliged to return it in the same condition. Otherwise, $15,000 plus VAT will be charged for each 1/4 of the tank missing, a charge that will be deducted from the guarantee left by the client.

The type of fuel required is indicated on the rented vehicle. If the wrong fuel is loaded into the vehicle by mistake, the costs of repairing any damage caused will be the responsibility of the renter.

Maturity, Payment Conditions and Guarantees

The vehicle is reserved with a deposit of $50,000 of the total value of the quote sent. The remaining balance, together with the guarantee, must be paid upon delivery of the vehicle.

The guarantee has a value starting from $500,000 or higher, depending on the vehicle and the duration of the rental. This guarantee can be delivered by credit card, cash or bank transfer. The guarantee will be returned within 24 hours after delivery of the vehicle, provided that an inspection has been carried out by the company.

The rental value, as well as any other additional services contracted, expires and is payable at the beginning of the rental contract. No refunds will be made for early termination of the rental contract.

Coverages

All the coverages mentioned below will apply only within Chilean territory and will not be valid in the event of negligence on the part of the renter and/or the driver of the vehicle. In addition, these coverages are not applicable in the event of non-compliance with the traffic regulations in force in the Republic of Chile.

The base rental rate includes the Basic Coverages, which are the following:

CDW (Total Loss and Theft Coverage): Covers up to the commercial value of the leased vehicle, with a deductible payment that is established at the time of contracting.
DAT (Third Party Damage Coverage): Covers up to 500 If the amount of damage exceeds this limit, the difference must be assumed by the lessee.

The coverage included in the base rate includes a deductible for any event that the lessee must pay. This deductible is 20 UF + VAT. In the case of theft, robbery, misappropriation or total loss of the rented unit, the deductible will be 30 UF + VAT.

It is important to note that damages caused by misuse or negligence of the tenant, as well as the

aggravation of damages, are not covered by the aforementioned coverage.

The renter also has the option of voluntarily contracting, for an additional cost, any of the following additional coverages offered by Rent a Car Montino:

SACA (Accessory Protection Coverage): Protects against theft of accessories. The following items are considered accessories, among others: spare tire, radio, antenna, wipers, front windshield, wheel covers, safety kit (fire extinguisher, first aid kit, reflective vest and triangle), side mirrors and the rearview mirror.
CPN (Tire Coverage): Covers damage to the tires of the rented vehicle that are not covered by CDW (except punctures).

Minor Accidents Not Covered by Insurance

Damages caused by misuse or negligence on the part of the lessee, as well as the aggravation of damages, are not covered by the coverage indicated above. In these cases, the guaranteed guarantee will be charged. The amounts to be paid by the lessee in the event of minor damages are the following, according to the part or piece affected:

Windshield, side windows and rear windows with damage: Full warranty amount.
Side view mirror: Total warranty amount.
Minor dents on windshield or side windows: Partial or total amount of the guarantee.
Broken or deformed tires: Full amount of the warranty.
Tire Rims: Total warranty amount.
Dents or paint chips on the bodywork: Total amount of the guarantee.
Spotlights (major or minor): Total amount of the guarantee.
Paint polishing: Partial or total amount of the guarantee.
Roadside assistance: Partial or total amount of the guarantee.
Loss of vehicle documentation: Partial or total amount of the guarantee.
Loss of vehicle key: Full amount of the guarantee.
Loss of accessories: Partial or total amount of the guarantee.
Other damage not covered: Partial or total amount of the guarantee. Additionally, if the vehicle is returned with:
Strong or cigarette odors, excess mud, animal hair, spilled food or liquids that dirty or stain the upholstery or any other part of the vehicle: Partial or total amount of the guarantee.

The roadside assistance service (cranes or mechanical assistance) will have a partial or total cost of the guarantee if required for reasons attributable to driving or misuse of the vehicle (battery charging, collisions, overturning, opening doors, changing tires, etc.).

Payment Methods

Reservation: To reserve a vehicle, a bank transfer must be made or payment must be made at Checks are not accepted.
Rental Service: On the day of delivery of the vehicle, which marks the beginning of the rental, the pending service must be paid using a debit card, credit card or transfer.
Guarantee: The retention of the guarantee while the vehicle is being rented can be made by credit card, bank transfer or cash.
